CommentSold, LLC (“CommentSold,” “we,” “us,” or “our”) welcomes you. We operate the website www.commentsold.com (the “CS Marketing Site”) and provide business customers (the “Merchants”) access to a suite of services, including ecommerce functionality, website hosting, and mobile applications (the “Services”). This Privacy Notice (“Notice”) describes the personal information we may collect from or about you or that you may provide when you access or use any content, functionality, or services offered on or through the CS Marketing Site and the Services and our practices for collecting, using, maintaining, protecting, and disclosing that personal information. As used in this Notice, “personal information” is information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you or your household.

CommentSold acts as a processor of data collected by our Merchants from users and customers of those Merchants (“Merchant Users”) via the Services. If you are a Merchant User who supplies data to a Merchant, you can access that Merchant’s privacy notice located on their site to learn how they may collect, use or share your data, ask them questions, or exercise rights that you may have relating to that data.

We use Sensitive Personal Information for legally permitted business purposes, including to (i) perform services or provide goods reasonably expected by an average person; (ii) detect security incidents; (iii) resist malicious, deceptive or illegal actions; (iv) ensure the physical safety of individuals; (v) for short-term, transient use; (vi) perform or provide internal business services; or (vii) verify or maintain the quality or safety of a service or device. We do not sell or share (as defined under California law) any Sensitive Personal Information.

We may use automated decision-making tools or the power of artificial intelligence ("AI"), including machine learning models, transformer-based AI models, and other algorithmic systems, to perform some or all of these actions. We do not engage in any automated decision-making related to the provision or denial of financial or lending services, housing, insurance, education enrollment or opportunity, criminal justice, employment opportunities, health care services, or access to essential goods and services.

COOKIES AND SIMILAR TECHNOLOGIES

We may use cookies and other tracking technologies (like web beacons and pixels) to access or store information. A “cookie” is a small text file that is placed on your computer or mobile device when you enter a website or a mobile app. It enables the website or mobile app to remember your actions and preferences over a period of time.

Cookie management: You have the ability to accept or decline cookies using our cookie preference center. Additionally, most browsers automatically accept cookies, but you can usually modify your browser settings to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the Services.

Browser Signals

Some web browsers have “Do Not Track” or similar features that allow you to tell each website you visit that you do not want your activities on that website tracked. Our website does not currently respond to “Do Not Track” browser settings or similar mechanisms. We recognize Global Privacy Control (“GPC”) signals for users who navigate to the Services using a web browser.

HOW WE PROTECT AND RETAIN YOUR INFORMATION

CommentSold takes seriously the security and privacy of the personal information that it collects. We have implemented reasonable security measures designed to protect your personal information from loss, misuse and unauthorized access, disclosure, alteration and destruction. Please understand, however, that no security system is 100% secure. We cannot guarantee the security of our databases, nor can we guarantee that the information you supply will not be intercepted while being transmitted over the Internet.

We retain your personal information based on legal requirements or business needs. Generally, we only retain personal information for as long as is reasonably necessary for our business purpose or as required by law. 

CHILDREN

CommentSold’s Services are not intended for anyone under the age of 18 and we do not knowingly collect personal information from anyone under the age of 18 through the Services. If you have reason to believe that a person under the age of 18 has provided personal information to us, please contact us at dataprivacy@commentsold.com, and we will endeavor to delete that information from our databases.

LINKS TO EXTERNAL WEBSITES

The Services may contain links to third-party websites (“External Sites”). CommentSold has no control over the privacy practices or the content of any such External Sites. As such, we are not responsible for the content or the privacy notices of such External Sites. You should check the applicable privacy notice and terms of use when visiting any such External Sites.

SUPPLEMENTAL U.S. STATE PRIVACY DISCLOSURES

California privacy disclosures

These Additional California Privacy Disclosures supplement the information contained in the Notice above. These Disclosures apply only to individuals residing in California.

We collect your personal information as described in the “SOURCES OF INFORMATION” section of this Notice.

We collect the categories of personal information described in the “THE INFORMATION WE COLLECT” section of this Notice.

Sale or Sharing of personal information: We do not sell personal information for monetary consideration. However, our use of certain tracking-technologies may meet the definition of “selling” or “sharing” as that term is defined by applicable law. We may have sold or shared the following categories of personal information with our targeted advertising service providers and partners: Identifiers, Geolocation Data, and Internet Activity Information. We do not knowingly sell the personal information of minors under 16.

We may use and disclose personal information for the business and commercial purposes detailed in the “HOW WE DISCLOSE INFORMATION.”

We retain your information as described in the “HOW WE USE YOUR INFORMATION” and “HOW WE PROTECT AND RETAIN YOUR INFORMATION” sections of the Notice.

Your California rights

California Civil Code Section 1798.83 permits California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us at dataprivacy@commentsold.com. Please be aware, however, that we do not currently disclose your personal information to any third parties for marketing purposes.

Submitting a privacy rights request

To exercise your rights, please submit a request to us by either calling us at +1 (888) 396-6706 or by emailing us at dataprivacy@commentsold.com. Making a consumer request does not require you to create an account with us. Applicable law may limit the number of times that you can submit a particular request within a 12-month period.‬‬‬‬‬‬‬

You may be able to designate an authorized agent to make a request on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf or if the agent attempts to exercise a right for which they are not legally authorized to do so.

Upon receiving your request to know, access, delete, or correct, we will need to verify your identity to determine that you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with information you have previously provided us. We may also use other verification methods as the circumstances dictate. We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. If we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity, and for security or fraud-prevention purposes. We may deny your request to know, access, delete, or correct if we cannot verify your identity.

CHANGES TO THIS NOTICE

We review this Notice regularly. If we make material changes, we will attempt to notify you and/or obtain your consent, as required by law. We recommend that you regularly review this Notice. Please refer back to this Notice on a regular basis.
